Instructor Agreement
Effective Date: March 8, 2025
1. INTRODUCTION
This Instructor Agreement (“Agreement”) is made between you (“Instructor”) and Witch Academy (“Platform,” “we,” “us,” or “our”). By registering as an instructor and submitting courses for sale on Witch Academy, you agree to comply with the terms outlined in this Agreement, our Terms of Service, Privacy Policy, and all applicable laws.
2. INSTRUCTOR RELATIONSHIP
2.1 Independent Contractor Status The Instructor is an independent contractor and not an employee, partner, or agent of Witch Academy. Nothing in this Agreement creates an employment relationship.
2.2 Non-Exclusivity Instructors are free to create and sell courses on other platforms, subject to any exclusive licensing arrangements they voluntarily agree to with Witch Academy.
3. COURSE CONTENT & OWNERSHIP
3.1 Ownership The Instructor retains all intellectual property rights in their course content. By uploading content to Witch Academy, the Instructor grants us a non-exclusive, worldwide license to market, distribute, and make the content available to students through the Platform.
3.2 Content Guidelines All courses must adhere to our content guidelines. Instructors may not upload any content that is illegal, defamatory, fraudulent, or violates third-party rights, including copyright and trademarks.
3.3 Modification & Removal Witch Academy reserves the right to remove or modify any course that violates this Agreement or our content policies.
4. PAYMENTS & REVENUE SHARE
4.1 Revenue Sharing Instructors will receive 80% of the net revenue from course sales. The remaining percentage is retained by Witch Academy to cover platform fees, transaction costs, and administrative expenses.
4.2 Payment Terms Payments will be made via PayPal on a weekly basis. Instructors must provide valid payment details and are responsible for any associated transaction fees.
4.3 Refunds & Chargebacks If a student receives a refund, the revenue from that sale will be deducted from the Instructor’s earnings. Chargebacks may also impact payouts.
5. TAXES
Instructors are solely responsible for reporting and paying any taxes associated with their earnings from Witch Academy. The Platform may withhold taxes where required by law.
6. COMPLIANCE & LIABILITY
6.1 Legal Compliance Instructors must comply with all applicable laws, including intellectual property laws, consumer protection laws, and data privacy regulations.
6.2 Indemnification The Instructor agrees to indemnify and hold Witch Academy harmless from any claims, damages, or losses resulting from their content, actions, or violations of this Agreement.
6.3 Limitation of Liability Witch Academy is not liable for any indirect, incidental, or consequential damages arising from the use of the Platform.
7. TERMINATION
7.1 Instructor Termination Instructors may remove their courses or terminate this Agreement at any time. However, students who have already purchased a course will continue to have access.
7.2 Platform Termination Witch Academy reserves the right to suspend or terminate an Instructor’s account for violations of this Agreement or any other platform policies.
8. DISPUTE RESOLUTION
Any disputes arising from this Agreement will be resolved through negotiation, mediation, or binding arbitration in accordance with the laws of South Africa.
9. CHANGES TO THIS AGREEMENT
We may update this Agreement from time to time. Instructors will be notified of any material changes, and continued use of the Platform constitutes acceptance of the revised terms.

By submitting courses to Witch Academy, you acknowledge that you have read, understood, and agreed to the terms of this Agreement.
